Benefit of the Doubt

VA Terminology Definition

Plain English Definition

When evidence for and against your claim is roughly equal (50/50), the VA must decide in your favor.

Why This Matters

This is a legal standard that works in veterans' favor. You don't need to prove your case beyond all doubt - you just need to tip the scales to 'at least as likely as not' (50% or greater probability).

Example

Two doctors disagree about whether your knee arthritis is connected to service. One says yes, one says no. Under benefit of the doubt, the VA should grant service connection.
